NDAs, Red Herrings & How We Handle Disclosure

Every submission is protected by a mutual NDA before any confidential material changes hands. It’s issued automatically as part of your confirmation — no separate request needed.

For businesses under consideration for a path toward public markets, we also work in Red Herring terms early. A “Red Herring” is the industry term for a preliminary prospectus — a red-flagged draft disclosure document, named for the red-ink notice on its cover, used ahead of a formal public offering to describe a company’s business, financials, and risks before pricing is finalized. Preparing these materials early, as part of the restructuring process, is part of what lets a qualifying business move quickly if and when it’s ready to list.
